Resumo:
Humanrights arerightsinherentto all human beingsandarise from the needto
protecthumanity.However, that acttorealize theserights, it is necessarya
positivestate actiontoensurethat, in practice,the dignityof the person, without
any formof discrimination, whether of origin, race, sex, color or
preferencereligious. In this context, it is necessary thatthe state guarantees
therecoveryof the individual.TheFederalConstitutionbringsinto your
bodypositivizationthese rightsasfundamentalrights, which are
expressedmainlyin Article 5. These arethekindofwhich social rightsare species.
The Magna CartaandtheBrazilian legal systemhasas its basic premisethe
protection of theserights, however, it is observed thatthis
protectionisoftenunsatisfactoryin this case.Thus, this paper seeks toanalyze the
effectivenessof human rights inBraziland for this, we use qualitative methods,
the deductive methodandtheliteratureto study the matter. In this vein, a
specialattentionrefersto the forcedmigration ofmanypeople fromHaiti.
Thesemigrantsfleeingpolitical, economicand socialcrisis whosetrigger wasan
earthquakein 2010that destroyedthe country.They come toBrazilin searchof a
betterlife,wanting to beacceptedas refugees. However, thenational and
international legislationdoes not understandthat peoplemovingby natural
disasterssharethis condition. Thus, under Brazilian lawshould besent backto
Haiti. However, the National Immigration Council(CNIg), an agency under the
Ministryof Labour andEmployment,suggestedthat Brazilshould welcomethese
peoplefor humanitarian reasons. Althoughthisnationalstance, occurhere
numerousviolationsof social rightsof Haitian migrants. Therefore, it is
concluded thatit is necessarythe development ofpublic policies that
guaranteethe protection of thesegroupsgiven theirvulnerable situation.
