Direitos sociais dos Haitianos no Brasil: breves reflexões sobre a eficácia da proteção dos direitos humanos.

Abstract

In this context, it is necessary thatthe state guarantees therecoveryof the individual.TheFederalConstitutionbringsinto your bodypositivizationthese rightsasfundamentalrights, which are expressedmainlyin Article 5. These arethekindofwhich social rightsare species. The Magna CartaandtheBrazilian legal systemhasas its basic premisethe protection of theserights, however, it is observed thatthis protectionisoftenunsatisfactoryin this case.Thus, this paper seeks toanalyze the effectivenessof human rights inBraziland for this, we use qualitative methods, the deductive methodandtheliteratureto study the matter.
