Abstract

It is mistake to think that judicial activity is provided solely by the performance of judges, for his performance alone is insufficient for a proper and efficient adjudication. This paper seeks to present, adapt and improve the function of the bailiff as a mechanism of conflict resolution and the consequent social pacification, greatly helping the promptness. The methodology used is the hypothetical-deductive method, working from certain assumptions. For the methodology of procedures using the observational method, based on the investigation of forensic practice was made, as well as legal-exegetical method. The issue lies exposed in the Constitutional provision that everyone is entitled to a response of the judiciary to resolve their problems. The problem of slow messes with everyone, without distinction, at any stage of life has become need of help by the judiciary and for sure, you want this body, granting or not granting of the question, can provide an answer to problem raised in a fair and expeditious manner, since if the party has no quick answer to the case, the response is slow and its effectiveness is compromised. Therefore, the theme of speed justice for all equally , which may contribute to further bailiff should be monitored closely because he, as the first to come into contact with the parties, may effect a reconciliation that is only expecting a small and minimal legal clarification. Thus, the resolution of these proceedings, the State Judge, have time to study and decide swiftly on the most complex litigation.
