Abstract:
The Conselho Tutelar is a permanent, autonomous and not judiciary organ of the government responsible for ensuring compliance and defense of both child and adolescent rights, according to the article 131 of the Statute of the Child and the Adolescent - ECA. The significance assigned to this organ concerning care and protection of the ones younger than 18 years old has required structural changes for a better defense of their rights. Aiming to analyze the changes arising from the Law number 12696/2012, this work has the objective of comparing the old and the new rules inserted on ECA. To do so, the study was sectioned in three chapters, the beginning concerns about the history behind the child and adolescent rights. The following is about the configuration and structure of Conselho Tutelar, before and after the innovations, which are exposed in the last chapter, where the Law number 12696 is analyzed focusing on the innovations that improves the operation and structural formation of the Conselho Tutelar.
