Abstract:
This monograph stopped to research the topic , notably by its current importance in a legal system where the state took upon itself the responsibility of providing public services to the community considered essential to the prevalence of human dignity , which is responsible civilly for damage caused as a result of this activity . The work brings with it the origin of the public service, and his concept lists the ways in which it can be provided, establishing outsourcing as one of the modalities of its delegation, emphasizing the advantages it can provide to the Administrative machine and ancillary tasks that can be transferred to the third party. The main scope is confined to the possibility of blame, primarily, the Public Administration for damage caused by the outsourced employee at the user or not of the public service. In this mister, the research was guided through a historical examination of the institute, chalking up the concept and study of the principles relating to the legal administrative system as well as the evolution of state liability to the current stage.
