Abstract:
The present work deals with the excesses committed against the media personality rights
of the individual, highlighting the disproportionate which use the principle of press freedom
at the expense of image and private honor, so to respect the principle of intimacy. The
losses arising from excesses committed by the press are massive, because both charges
the State as incalculable because the image of victims and their families, a factor that
hinders the establishment of a just and proportionate to the damage suffered damage
repair. Making a study of the historical evolution of these principles since its inception to
the present day proposed to make an analysis of the positioning of our courts regarding
the moral damage done by journalists in media abuse of the right to inform and influence
of media on parental legislature in the creation of laws. In this context, this monograph was
developed using the historical-evolutionary, exegetical and legal and finally used the
method bibliographic methods.
