Resumo:
The criminalization of drugs is one of the most significant issues in criminal law. It is
a major cause of incarceration , with its repression a major cause of increased violence . The
prohibition has long become a problem considering having become a many times greater
problem than those arising from drug use that aims to prevent harm. The present work aims to
study critically , through data collected from various sources , the damaging effects of
prohibition of cannabis sativa to users , persons directly or indirectly related to the sale of
narcotics , as well as to society in general . This analysis and the proof of the inadequacy of
the current repressive model makes is necessary a critique the light of criminal principles in
order to demonstrate that cannabis prohibition is delegitimates and, beyond of all, a source of
human rights violations . Then starts to study how overcoming the repressive paradigm by
studying the decriminalization and legalization , alternative ways of dealing with narcotics.
