Resumo:
In this scientific research is examining the development and implementation of
privatization in Brazilian Penitentiary System . It aims to initially explore the
theoretical and analytical discussions on the privatization of prisons . As well , report
and analyze the system privatization of prisons , checking the structure of this service
on state responsibility. And therefore , describe the advantages and disadvantages
relevant to the implementation of the privatization of the prison system , from the
perspective of the convict , society and the State . In the course of the work will
address its historical evolution , describing the emergence of the right to punish in its
various facets to the appearance of the first prison in the world . Following up with the
the approach of the birth of the first prisons in Brazil , describing their specificities , as
well as highlighting the reality that lies above the prison system patriotism. Ending
with the demo models privatized prison systems , as well as addressing the obstacles
to privatization , highlighting current examples of privatized prisons . The work
consists , in relation to their theoretical , research on internet sites , more specifically
in electronic articles , court decisions and current laws and doctrines of renowned
authors on the subject . Trying to succeed in research , we use the method of
deductive approach , as well as the method of procedure structuralist where
investigates the phenomenon in question concretely to , then put them in the abstract
level , seeing reality the internal point of view . Attached to the research technique of
indirect documentation , in order to identify key factors and intrinsic to the
privatization of the prison system . The topic is of high renown , as highlighted by the
search for a solution to the crisis in the national prison system , highlighting the
privatization of prisons as a possible solution to the problem presented , the target of
several discussions among jurists of repute. Therefore , concluding that study , it was
found that the hypothesis is confirmed now raised , given that one of the quicker
solutions , viable and responsive to the chaos that is the current Brazilian prison
system , is the privatization of this system .
