Resumen:
The Brazilian prison system has been the target of countless criticisms related to the high rate
of recidivism observed in its former inmates. Such observation leads to the scientific analysis
about to whom it must be assigned the responsibility for such a negative socio-legal pheno menon. Identified the importance of the matter, this monographic work, taking as spatial cu tout the Prison System of Sousa (PB), aims to look into the posture of the State and society,
with regard to social and legal duty of providing alternatives to the former inmates of this
system capable to mitigate the socioeconomic effects caused to them, as a result of the serving
of a deprivation of liberty penalty, focusing on the process of social victimization faced by
them. So, the objective of the research is the analysis of the responsibility of the former in mate, the State and society regarding the phenomenon of recidivism. The construction of the
study uses as a method of approach and the empirical-inductive method and method histori cal; for this purpose two kinds of research approaches were verified: the first is based on a
theoretical reference consisting in analysis and bibliographic survey, then performs a field
research materialized in two stages, which are, the application of questionnaires in some so cial segments and the realization of semi-structured interviews with the constituted authorities
in the legal criminal field of the investigated City. For the study of the results, the discussion
is represented through charts related to the tabulation of the questionnaires and the content
analysis of the interviews held; all by the use of the technique of indirect documentation.
From this analysis, it can be verified that the former inmate of the Prison System in the city of
Sousa (PB) faces major problems when returning to society, especially regarding to the diffi culty of economic and social inclusion, since it ends up being labeled with negative impres sions that accompany the former inmate creating obstacles for a life with dignity, away from
the practice of criminal activity, which leads to consequences of severe proportions, such as
recidivism and the consequent increase of the criminality. Even though several discussions
about it are lifted, in order to find a solution for the promotion of the effective ressocialization
of the former inmate, it is concluded that the best way lies in the interaction between the so ciety, the State and the former inmate.
