Projeto pai legal e a efetivação do direito à identidade na comarca de Sousa - PB.

Abstract

Based on reflections on the institutions of family, the question of membership and restore the dignity of the human person, this work aims to analyze and infer the results achieved by the project acknowledgment of paternity called "Pai Legal" (father legal), now underway in County Sousa, in view of the serious social problem of more than 650 students from public schools that do not have the father's name on the birth record. Every effort should be made towards the protection and enhancement of human dignity. All social actors must have their participation so engaged and responsible. The right to membership is set stemming from a fundamental right to identity, which takes place within the family. This right has been systematically denied by the absence, by inertia or inefficiency of public policies to more than four million (4,000,000) people in Brazil and another 650 in the region of Sousa / PB. The Project “Pai Legal”, driven by provision No. 12/2010 of the CNJ, has sought to resolve this issue by performing the procedure induced the Law 8.560/92. This study examines the elements that constitute the family and the affiliation, which is embodied by the right to identity, aiming at understanding how the same fundamental right. Therefore, the deductive method are used as a method of approach, methods historical, comparative and case study methods and procedure documentation and indirectly through the management of the elements of literature as a research technique. After doctrinal analysis and documentary realizes that as a result of the Law 8.560/92 project became effective for the transformation of many lives in the jurisdiction of Sousa. that the present work has reached its goal, to analyze the “Pai Legal” Project in County Sousa and infer the results achieved by the same instrument as director of Law 8.560/92, ie, as a means booster as necessary acknowledgment of paternity.
