Uma análise da eficácia da medida sócio-educativa de internação.

Abstract

The Brazil and the world are currently facing a serious question as to the behavior of young people, increasingly detached from the values recognized by society at that particular age group, individuals have strong tendencies toward deviance, often coming to delinquency for several reasons. The most worrying is that in addition to many join the harvest of crime in general, having accomplished the socio-educational measure, return to commit illegal acts. It is known that the detention is intended to avoid the punishment, but the rehabilitation of young offenders. In this context, the scientific problem that guides this work is whether the socio-educational internment is sufficiently effective as the rehabilitation of the offender. As a hypothesis, it has not; considering the shortcomings occurring in the system. Thus, the objective of the research is to analyze the effectiveness of socio-educational hospitalization. Specific objectives are pointed out: study legislation juvenile, regaining its historical elements, particularly with regard to the practice of offense; identify the socio-educational measures in force in Brazil, as well as its governing principles; carry the discussion of results of empirical research proceeded by CNJ and published a report on the worldwide web. To do so, it will employ the hypothetical-deductive method, assuming that the socio-educational hospitalization does not reach the desired effectiveness by the state. As a technique for research will be used literature, as well as indirect document. Finally, we seek to show that it is the sum of several factors that they create in society a vicious circle that leads thousands of teenagers to a path of no return.
