Résumé:
This work has major scope discussing the evolution of prison regimes in Brazil and in
the world, giving basis to a general evolutionary historical, ranging from the most archaic forms of punishment to the present day, in this sense we will also discuss how
happened the appearance of the custodial sentence and the form it evolves using an
historical method and compared with applied deductive research technique and quantitative and direct and indirect, aiming to analyze the progress that can occur with the
effective use of electronic monitoring system, to introduce concepts and definitions in
the area of penal execution, knowing doctrinal and jurisprudential opinions about the
assistance given in the Law of Penal Execution and evaluate the benefits and advantages of using electronic monitoring device, reasons and foundations of its applicability. Emphasizing the difficulty of state problematic about the use of electronic monitoring system, which can improve and reformulate prison systems of execution and
progression of sentences, making them more rational and coherent, hypothesizing that
this monitoring equipment is new and came to revolutionize our prison system in the
part dealing with the execution of the sentence, giving more chances of re-socialization
and full conditions of humanizing the system. In the second phase will deal with the
practical aspects of the execution of the sentence, emphasizing its theoretical perfection and its trivialization with respect to practical social aspects, which consequently
will influence the delay and failure in trying to re-socialize, the amortization process of
the sentence and even the restructuring of prisons in general. In the third and last time
and now addressing the central theme title of the work, which is the electronic monitoring of the convict, we will treat this important equipment used in the progression of
the imprisonment system, the reasons and foundations for its implementation and still
will defend its use, pointing out the advantages in practice and giving example of several countries that have succeeded in compliance with the use of the device. believing
that the adoption of an effective policy assistance, supervision and support egress,
making it achieved what is provided for in the Penal Execution Law, this because if the
present situation persists, the egress unassisted today will remain the offender recidivist tomorrow.
