Resumo:
The collective shopping, consolidated worldwide in 2008, was established in Brazil
after only two years, with the website Peixe Urbano, corresponding the new
worldwide fever consumption. Characterized by selling coupons they receive
discounts up to 90% to a specific number of people interested in the same product or
service, whose sale is intermediated by a site that uses its name to promote and
disseminate such offer. The collective buying has become the subject of major
complaints when it sought to examine the liability of those who gave rise to the
problems arising from this commercial practice. As a result, the goal of this study is to
make clear that even tough there is no such a specific legislation regarding electronic
commercial transactions, it is possible to apply the Consumer‟s Protection Code in
the view of the theory of Dialogue sources as a support to the integrated rule showed
in the article 4 of the Introductory Law to the Brazilian Standards Law. Furthermore,
the report aims to study the issue raising the law projects, newly approved Decree,
current public policies related to e-commerce and some independent mechanisms,
all for the sake of improving consumer‟s operation transactions before the collective
shopping. Furthermore, the methodological procedure being used in the literature,

published regulating consumer protection and some mechanisms such as the Citye.net, which operates independently, with a focus on improving the functioning of
consumer transactions before the collective buying.
