Resumen:
This research deals with the freedom of the press against the presumption of
innocence, highlighting the complexity in repairing the damage the image,
highlighting journalistic activity to be exercised in collision with personality rights,
violating the right to honor, image, privacy . Being exercised differently than precepts
essence overseeing the search sponsor, enrichment of the owners of the media,
politics and promotion of journalists. To be able to analyze the issue was necessary a
study about the concepts of constitutional provisions, rights of personality, civil
liability, highlighting its objectives and its historical evolution. To then find the
diversion of purpose that are imposing upon their interpretation, verifying how these
principles are in collision, showing the work of sensationalist media, and freedom of
inprensa as suppressor of personal rights. And the difficulty of judges to act in cases
where the collision occurs, beyond the conduct of the offenders, with total disregard
for the image and honor of others. Besides the verification methods used during the
research, bibliographic, historical evolution, the legal exegetical also the inductive
method.
