The Federal Law 9.433/97 established the National Policy of Water Resources, with foundations in decentralized management and participatory, with the territorial unity of planning the basin. That legislation establishes that water is a scarce resource and economic value and introduces the charges on the use of water resources as one of its instruments of management, with the Committees of Basin establishes mechanisms and values to be charged. Also at various states of the federation, the state of Paraiba, establishing its State Policy of Water Resources (PERH) through the Law No 6.308/96 (referenced by Law No. 8.446/07), whose principles and foundations are in line with the general guidelines of action of the Law 9.433/97. There are many questions and controversial aspects on the implementation of charging for the use of water in the country and in particular in Paraíba. One such aspect concerns the resistance being faced regarding the insertion of the users of water from the agricultural sector in recovery system. The general objective of this thesis lies in evaluating the perception and positioning of the users of water from the agricultural sector “paraibano” forward to the implementation of the policy of charging state in river basins, examining the extent to which the implementation of the tool can act as an economic incentive to attitudinal change of this segment productive, for the use and disposal of water. It was used in this argument, a case study, with the focus of the industry analysis of the “sucroalcooleiro” sector “paraibano”, represented by an agroindustrial units and the suppliers of the cane mesoscale region of the forest “Paraibana” the importance and expressiveness engaged in agricultural production state. The results indicate that, unlike the new classic’s that require the foundations on which to inspire the policies of national and state water resources, the response of the industry, the recovery of water should not be strictly economic embossing as expected, since such a response difficult to give way to individualized since there is an agroindustrial chain that conditions particularly the technical and political behaviors of local producers. With that, discusses is also about possibilities and alternatives regarding the construction of participatory strategies geared to the exploitation of water resources state, which may act with effectiveness, as a positive incentive to the adoption of agricultural practices compactable with the thoughts of preservation requirements state legislation water resources.
