Resumo:
That there were more than 10 million informal enterprises operating in the country. The
research revealed that the vast majority of these companies were informal workers who
owned small business to provide their livelihood and family. Faced with this reality, the state
is compelled to look for an alternative that would resolve this problem and would change the
informal situation in which the workers find themselves. To solve this problem Individual
Micro Enterprising was introduced by the LC 128/2008, whereby millions of autonomous
entrepreneurs, entrepreneurs by opportunity and unemployed persons had a chance to open
their own company with low costs and facilities that would promote the continuation of the
company. Consequently, the objective of the present operation is to investigate the
socioeconomic impact that the LC 128/2008, by dint of the Individual Micro Enterprising,
brought to the state of Paraíba, with regard to the effectiveness of socioeconomic
development and implementation of the rescue of the citizenship of these entrepreneurs, as
well as making a survey to profile this new entrepreneur and the main reason that led to the
formalization. To make this survey, data of the research applied by SEBRAE Paraíba were
used. To achieve these goals, the inductive method was used as a method of approach, the
historical evolution method, as method of procedure and as a research technique, the
theoretical, which will be worked out by literature review, where the doctrines, legislation,
judge-made law and scientific articles were used as an appliance to base and support the
approach of the object, and secondarily, the practice, because information empirically proven
or found in a given sample will be necessary for the investigation of the theme. Accordingly,
it was detected that the creation of the MEI, by the LC 128/2008, allowed the removal of
millions of workers in informal situations, by giving these individuals the opportunity to
govern their own business and their Socioeconomic status in society, which allows the new
manager the ability to enjoy their rights as Brazilian citizen, and consequently, the state can
actualize beyond the constitutional principles of the economic order, the basic principle of
every law: the dignity of the human being. The last census conducted by the IBGE (2003) on
the informal economy in Brazil, showed.
