Resumo:
Torture is one of the most disgusting and disrespectful to human. Therefore, it must
be fought with an iron fist for humanity. His practice is still widespread throughout the
world, this represents a huge setback in the walk against torture since affront
indisputably the protection and enhancement of human rights in an international
context. This issue deserves due attention by the authorities, who insist on remaining
oblivious to the problem, as society witnesses the atrocities resulting from the
practice of this scourge and cries out for solutions. Signatory to various covenants
and conventions promoted by the United Nations aimed at effectively combating
torture worldwide, Brazil has condemned this crime in its own Constitution and
subsequently edited the Law No. 9.455/1997, which defines the crime of torture. Still,
in an informal way, torture is still practiced in Brazil. However, that law has limitations
and one of the main factors contributing to it is the poor definition of torture, which it
appears. And, by not clearly define what is torture, with a narrow concept - that does
not follow the standards of classification established by the Convention against
Torture, established by the United Nations, this law helps to perpetuate the
continuation of torture in Brazil.
