Resumo:
This monograph begins by addressing the evolution of pen throughout the history of
mankind up to the present purpose of analyzing the historical worth and prison
systems, treating and how was the story of the sentence in Brazil. Further attempts to
explore the origin and history of human rights , their characteristics and ideals that
influenced the evolution of the current legislation and how these rights are protected
and guaranteed by the legal system and the parental entering prison soon after the
historical perspective of the prison girly being made considerations on the issue of
gender and conflict with the penal system, and then enter into the overall goal of this
work is to reconsider the current situation in the Brazilian female Incarceration
forward the promotion of Human Rights which originated in a patriarchal political
where the woman was restricted to the home environment, dealing with the female
prison system and Human Rights, protection and guarantees provided , failure and
difficulty by the State to enforce such rights , generating national and international
concerns about the application of these rights in Brazil. With the following specific
objectives: to present concepts and definitions in the area of criminal enforcement,
specifically regarding the guarantees and rights granted during the execution of the
sentence for woman; know the doctrinal and jurisprudential opinions on the defense
of human rights; reality show Brazilian female prison; analyze the state responsibility
in the treatment of women subjected to deprivation of liberty, and also ascertain the
needs of the female prison population in Brazil. To enable the development of
theoretical and achieving the objectives mentioned monograph will use the inductive
method, exegetical and legal and legal - historical method, use of technical literature
on legal texts, teaching and scientific analysis of the laws .
