Resumen:
Children and adolescents in Brazilian society went through various processes of
social, political, economic and legal. Since the colonial period, childhood was marked
by living abandoned on the logic of charity and coming philanthropy of the Catholic
Church, then with the Proclamation of the Republic and the adoption of the
Constitution / 1988 was legitimated the Statute of Children and Adolescents (ECA) /
nineteen ninety. This process was acquired through discursões in favor of the rights
guaranteed, as are provided for in art.112 socio-educational measures applied to
adolescents who have committed illegal acts. In this sense the research aims to
understand the adolescents in conflict with the law within the Brazilian historical
context and specifically in the city of Sousa-PB, to ascertain the half-open action
performed in the Specialized Center for Social Assistance (CREAS), among them
Freedom assisted (LA) and Service Delivery Community (PSC) if they are effective in
the educational process, as well as leading a teenager to commit such an act.
documentary research was carried out bibliographic and field, with application of
semi-structured questionnaires with CREAS Technical team and the Childhood Court
Judge and youth both de Sousa-PB. The same is characterized as a qualitative
exploratory study, considering the analysis through the dialectical critical thinking.
With the study we stress teens who commit illegal acts mostly are in a situation of
social vulnerability, characteristic of lack of investment, thus needing a mutual
supplement between Society, State and family and especially investments in public
policies by the State both for the realization of fundamental rights and the institutions
that perform educational measures. It should be noted that adolescents who meet
the measures Sousa, are not effective because the difficulty of the institutions
implementing them. It is understood that with the ECA, children and adolescents
gained a breakthrough in the guarantee of rights, but also need greater effectiveness
in public policy and in confronting social issues.
