Inteligência artificial e direito: uma análise sobre os impactos de novas tecnologias e o uso da inteligência artificial no Judiciário Brasileiro.

Abstract

The present paper brings the theme: "Artificial Intelligence and Law: an analysis of the impacts of new technologies and the use of artificial intelligence in Brazilian judiciary" and performs a historical and interpretative analysis on this subject. A reflection on the importance and influences of the use of technologies and artificial intelligence in the judiciary has been proposed to reach the result. The problem of the research referred to how the use of these technologies will significantly affect Brazilian judicial context and how the use of artificial intelligence is getting closer and closer to judicial routines, however it still needs a better understanding of its functioning to be able to get into higher levels. The text approached the necessity of the use of technology for a better functioning of the legal service as well the evolution of society that is more and more conected to technological resources. The general objective of the research was to analyze the use of new technologies and artificial intelligence and their impact on Brazilian judiciary. On it turns, the specific objectives consisted on analyzing the process of transformation of law, technological evolution and the future of Brazilian judiciary; discussed the implementation of new Technologies, the history, concepts and functioning of artificial intelligence; and, observed the use of artificial intelligence in the lawsuits. On its methodology, the work was developed using a documentary bibliographic research as a technical procedure. The deductive method has been used as the method of approaching and the qualitative one as the method of analysis, which was based on the use of books, doctrines, websites, scientific articles, magazines, term papers and legislative texts, with the objective of reaching understanding according to the current social context on the use of new technologies. According to the objectives of the work, the research was taken in a descriptive and explanatory way, using the historical and comparative methods of procedure with the purpose of exposing aspects and elements that make up the project. It was possible to conclude that the use of artificial intelligence provides several benefits to the jurisdictional provision and Brazilian judiciary tends to expand in this scenario. Thus, a continuous Evolution of artificial intelligences is necessary, in order to be better understood and evolve without bringing insecurity in their use.
