Abstract:
The aging of the Brazilian population is a reality, and as a result, society begins
to face some problems that were not previously identified. The present work
proposes a study of one of these problems that currently provoke a wide
discussion in the legal environment, it is the reverse affective abandonment. The
lack of affective support and family life can cause the elderly serious physical and
psychological problems, therefore, it is necessary to verify the possibility of civil
liability of children for the practice of emotional abandonment. To this end, the
protection given to the elderly in Brazilian legislation, the consequences caused
by emotional abandonment and the civil liability institute were listed. Through
bibliographic research, in laws, doctrines, articles and other pertinent sources, a
certain conclusion was reached. Although there is no specific law that typifies the
conduct of reverse affective abandonment, such conduct is liable to
condemnation, as it has the assumptions of civil liability.
