Mínimo existencial e o acesso á informação como ferramenta de transição social: uma análise sobre direitos fundamentais,limitações estatais e desigualdade social.

Abstract

This study deals with the Theory of the Minimum Existential, in which it is questioned whether there is a reliable line to establish what is indispensable to the population. Moreover, not only is the concept of state accountability understood, but mainly that of the marginalized classes in a selective and continuous abandonment of the genesis of new demands, previously superfluous and now essential in the light of social inclusion and in the search for full access to justice and information, as will be analyzed later. The problem lies, in general terms, in the search for the definition of what would effectively be the so­called legal minimum, which can be altered according to the economic/social class to which the enunciator belongs. Aiming as an observation point the basic and social rights that behave in the circumstances in which the population is currently placed. The methodology used was that of reevaluating the historical and bibliographic concepts touching on the subject, which was established through induction. The purpose was an explanatory and exploratory study and the approach was quali­quantitative. Faced with this, the concentration of public policies is far from belonging to those in need, being slightly more vulnerable to public opinion, increasingly participatory and popular, even capable of changing political forces and moving the judicial or legislative machine.
