Resumen:
The electoral law, like any other legal branch, is subordinate to the dynamics of society,
as it is justified by it. When dealing with the rules that govern electoral institutes, it is
necessary to be even more cautious, as they are elements that directly influence the
exercise of Democracy in the country. EC Nº 97/2017 brought new rules that will
restructure the modus operandi of political parties, making sure that political
articulations do not focus solely on the search for the holding of political power, but on
the fulfillment of principles and foundations essentially democratic and republicans.
Among the new electoral rules, this work will focus on the impossibility of party
coalitions in proportional elections. After the amendment, the political parties, in
proportional elections for the positions of deputies, federal and state, and councilors,
will no longer be able to relate to compete for positions. Since the existence of this
possibility of coalition for the election of these positions occurs since the Constitution
of 1988, it is very important to reflect on the changes and consequences brought by
the amendment. If the justification for eligibility only through participation in a political
party is due to the function of catalyzing the will and ideals of citizens, why do coalitions
establish themselves only during the electoral period for the sake of convenience,
without any affinity between the related parties regarding the government program or
ideology? How will the dynamics of the next elections be, in other words, the way in
which political parties will articulate, given the withdrawal of an articulation used for
years by political parties? One of the most emphasized aspects in this work is that the
constitutional novelty has polished the principle of representativeness, bringing to the
fore the expectation of an electoral reform that promotes the rapprochement between
voters and a legitimate political representation. For this purpose, a qualitative research
was used to search for results through perceptions and analyzes of party behavior
combined with the study of electoral literature, as well as a historical and bibliographic
analysis of the electoral institutes that surround the theme.
