Resumen:
The Constitutional Amendment 103/19 changed the social security system. This
research aims to study the changes brought about, no longer concerned with the health
of the worker when he established the minimum age for granting the special retirement
benefit linked to the minimum time of exposure to agents, making the worker remain
more time exposed to harmful agents. To achieve the objectives, the hypothetical-
deductive approach method was used, the method of historical evolutionary and
comparative procedure, as a research technique, the bibliographic and documentary
was used, based on scientific research already done on the theme, as well as the
protection of the legislation . The concepts and characteristics of special retirement
and its relationship with workers' health were analyzed, comparing their main devices
before and after EC 103/19. It was concluded that Constitutional Amendment 103/19
brought a major setback to fundamental social rights.
