Abstract:
The present study has as its main objective the analysis of the new modalities of work
focusing on digital platforms, analyzing the employment relationship between
deliverers and apps and the verification of the employment relationship, as well as
deregulation in relation to disruptive technologies. For this, it was analyzed how the
work on demand occurs and all the requirements that configure the employment
relationship. International and national decisions on the subject were also pointed out.
Considering the absence of Brazilian regulation regarding digital platforms, it was
shown the importance of examining the precariousness experienced by couriers and its
worsening with the COVID-19 pandemic. For the study of the theme, bibliographic and
documentary research were conducted, through the deductive method, in addition to the
qualitative research methodology. Through this research, one can realize that the
deliverers are subject to degrading working conditions, due to a false promise of labour
freedom and legal insubordination of digital platforms, which characterizes them as
false self-employed. Moreover, it is observed how essential is the effective performance
of the Labour Law as a way to consummate its protective essence. Thus, the importance
of analyzing the theme with special attention of jurists, government agencies, the
Executive, Legislative and Judiciary Powers and civil society was verified in order to
guarantee the labor rights of the deliverers as a way to realize the principle of human
dignity.
