Abstract

The present work is dedicated to the analysis of the public policy councils contributions in the health field in the structuring and maintenance of the Unified Health System (known by the acronym SUS), examining the role played by them in guaranteeing the right to health as a social right in the Brazilian State. It also seeks to observe whether these health councils are effective in the daily activities of the Public Administration, in compliance with the provisions of the legislation that is relevant to the theme. To this end, an exploratory research was developed, analyzing the bibliography associated to the subject and the legal documents that deal with the matter, such as texts, laws, decrees, ordinances and other pertinent documents about the provision of these important mechanisms for popular participation. and its conditions of effectiveness. In addition, the historicalevolutionary and comparative methods were handled, as well as the inductive and exegeticallegal methods, aiming to critically analyze the performance of these councils with the SUS and their effectiveness in substantiating the premises foreseen in the Federal Constitution of 1988 (CF/88), as well as the characteristics and common points of the institutes. In the end, it was found that the health management councils are essential mechanisms both in the construction and conservation of the SUS, since they are essential in the management of public health policies and comply with the provisions of national legislation. It was noticed that, while facing the COVID19 pandemic, the performance of these Councils is a determining tool for the inspection of state actions for the adoption of all security protocols in the pandemic conflict. It could also be ascertained that sometimes these councils are legally instituted in Brazilian municipalities, but they do not implement their guidelines, sinning in the publicity of their actions, in the training of councilors and even in the knowledge of the population. For this reason, it is suggested a greater dissemination of these councils’ actions, with the development of online portals so that the population has easy access to the contributions of these councils, and can even inspect their performance. It is also suggested the provision of technical courses so that the councilors can have a more accurate knowledge of the councils' duties, examining the relevant legal documents, as well as offering educational lectures within the councils in order to bring more technicality to the councilors.
