Resumo:
The present research aims to analyze the influence of the media on the
judgments of criminal cases, especially that ones with political relevance. Its
objective is deeply detail the criminal populism in the legal and social scene as
well as approaching its influence on different means of social control which are
conected to the media that has a fundamental and relevant role with duty of
information that often crosses the limit. Then, it inicially seeks to analyze the
media process in parallel to the right of information and to the principle of publicity
using a deeper understanding of constitutional aspects. A difference between
media and press is listed as an important instrument with the purpose to aim at
sensationalism that is present in television media within the Trial by Media's is
very relevant with its strength and interest in controlling public opinion, especially
in judgments which involves political representations. In this terms, the forms of
influence and their bonds were present in the development of the research.
Considering these facts the problem is: however the right and the duty to provide
information, does the media respect the limit so it can not compromise the
conduction of the criminal process? The deductive method has been used once
the work is based on the collection of information. Bibliographic research has
been used as research technique by the use of bibliographic survey of doctrines,
jurisprudence and academic papers in addition to official websites and
databases.
