Resumen:
With the increasing modernity and use of the digital medium, it is an observable fact
the gradual bombardment of information on a daily basis, which induces the
construction of a fine line between information and disinformation. In this sense, the
present work of completion of course aims to address the issue of the phenomenon of
Fake News in contemporary times and its interfaces with the Fundamental Right to
Freedom of Expression. Thus, in view of a society increasingly dependent on
information technology, it should be noted that such modernization guarantees a
greater possibility of access to knowledge, but at the same time it generates
adversities, such as the issue of the exorbitant amount of information received daily,
which makes it difficult to identify what is or is not true in the virtual environment. Under
this bias, the Right to Information clashes with the Right to Freedom of Expression, so
it is necessary to debate the extent to which one can lead to the limit of the other's
effectiveness, considering that the phenomenon of false news reaches the entire
medium social, political and virtual; which goes against the guarantee of human dignity
and the achievement of social democracy. In methodological terms, we opted for
bibliographic research and document analysis; from the analysis of several laws and
jurisprudence, as well as the Federal Constitution itself, as well as the consultation of
scientific articles, academic works, doctrines and journalistic materials, based on the
deductive method. Finally, it is possible to deduce, from the jurisprudential and
scientific analyzes, that, although necessary for the construction of a democratic and
healthy discourse, freedom of expression is not an absolute right and can, therefore,
be limited, albeit subtly , from the moment that this fallaciously injures the dignity and
well-being of the other.
