Resumen:
The subject of bids and contracts has always been the subject of debate in the scope of
administrative law as it involves the discretion of the administrator, as well as the public
interest, especially after the enactment of law nº 14.133/2021, which revoked some articles of
law nº 8.666/93, but will act in parallel to this until April 2023, when the older legislation will
be repealed completely. The present work has as its theme The discretionary forms of Direct
Contracting in Public Administration: Analysis of Contracts performed at CCJS-UFCG. The
object to be studied will be two contracts carried out within the scope of the CCJS-UFCG, one
in the reverse auction modality and the other in direct contracting, highlighting the main
differences between the two. As objective, the research seeks to analyze what are the impacts
caused by the Center for legal and Social Sciences in the city of Sousa-PB when they opt for
discretionary modalities of direct hiring. To reach the general objective, the specific objectives
are: a) analysis of the bidding modalities; b) hypotheses of waiver of bidding and c) analysis
of direct contracts carried out by CCJS-UFCG. Subsequently, brief notes will be made about
the theory presented in this area and with the aim of collaboration; this investigation proposes
the following research question: when the legislation allows, does the Center for Legal and
Social Sciences in the city of Sousa-PB use forms of direct contracting? The methodology
used is bibliographical, with a qualitative approach.
