Resumo:
Rural workers, whether agricultural workers, artisanal fishers or rubber tappers, have
their rights protected by Social Security, just like any other citizen. This exerts an
activity of great effort in the field for family subsistence and that often leads to
physical wear and tear. In this way, with the working time, the special insured seeks
their rights through retirement to guarantee a better quality of life during the third age
stage, thus becoming an active beneficiary. With the approval of Law nº 13,846/2019,
impacts may occur that will have large proportions on the national scene, reaching
the rural worker. Thus, it is possible to perceive the need for the suffering and
arduous life of this category. The objective of this study was to know the impacts
arising from the enactment of Law nº. 13,846/2019, which brings the requirements for
proving the quality of special insured, and the functionalities of rural workers unions,
based on the proposal for a Constitutional Amendment ( PEC No. 6/2019), which
was approved in the form of the Conversion Law Project PLV
11/2019. As well as,
Identify the adverse effects caused to rural workers by Law nº 13.846/2019 and verify
the usefulness of the selfdeclaration
issued by the INSS and ratified by the rural
workers union. To reach the information of this study, this was characterized as a
bibliographical research that searched in articles and books, subjects that would
provide relevant data to obtain knowledge about the proposed theme. The deductive
method was used, seeking to reflect on these issues, the present work was divided
into three main topics. In the first, the perception of the special insured is presented,
in the second topic, it talks about the necessary requirements to prove the quality, its
maintenance and loss of the quality of the special insured. In the third and last topic,
it soughts to address the main changes that occurred from Law nº 13,846/2019 in the
social security system, which made it difficult to prove the requirements for the quality
of special insured, in addition to the loss of autonomy of rural unions, as well as the
changes in the selfevaluation
of the rural worker. Therefore, it is concluded with this
work that it is judicious to think about the class of special insureds and realize the
embezzlement that their rights will receive, the limitations and bureaucracies that will
make the information arrive in a distorted way, harming those who greatly need the
benefits provided by the INSS. Therefore, it is urgent that an educational work to be
developed with the special policyholders becomes urgent, as they have been
affected by these new rules and because they have many doubts about the new
system. It is essential to clarify the importance of carrying out and maintaining their
registration, under penalty of seeing their rights perish.
