Abstract:
This paper develops an analysis of the impacts of the covid-19 pandemic on guaranteeing the human right to education of children and adolescents, with the purpose of protecting the interests of the public of compulsory school age, aiming to reduce the impacts caused by the suspension of classroom lessons. In the Brazilian scenario, there is a constant difficulty in ensuring access to education, especially for the low-sufficient population, who historically have been prevented from attending basic education due to various social factors. In a scenario of sanitary and economic crisis, this situation has worsened, even generating new impacts in the pedagogical and social fields, directly affecting the access to education of children and adolescents in a situation of economic vulnerability. In view of this problem, this study aims to give visibility to this educational situation, especially for these marginalized groups, drawing the attention of the judiciary and public administration. The study intended in this work has as a method of approach the hypothetical-deductive
approach, in which it starts with a problem, going through the formulation of a hypothesis and is developed through deductive reasoning. For the procedure, the historical method was used, as the research was constructed under a historical perspective, following the evolution of the researched object. The technical procedure used is bibliographic, making use of documents, scientific articles, books and websites. The work comprises three chapters, the first of which analyzes the historical aspects of the human right to education and its evolution in Brazilian legislation. The second chapter discusses the right to education specifically for children and adolescents, as well as its characteristics. The third chapter portrays the impacts resulting from the sanitary and socioeconomic crisis resulting from the covid-19 pandemic, dividing these into direct impacts and indirect impacts. Thus,
analyzing the researches and an in-depth study on the educational situation of children and adolescents in the context of the covid-19 pandemic, it is concluded that there is an ineffectiveness in guaranteeing the right to education for the group of compulsory school age, being necessary , therefore, the attention of the legislator and the public administration in order to give protection to this group.
