Análise constitucional do pagamento de “aposentadorias” a ex-governadores e de “pensões” a viúvas destes no Estado da Paraíba.

Abstract

This research aims to analyze the benefit of special pension given to former governors and their widows in the state of Paraíba, due to the fact that they once were elected. The benefic is analyzed, primarily, according to administrative, constitutional, and social security principals. To build some knowledge regarding the benefits instituted by the Brazilian Social Security Services, the social security benefits previously mentioned are going to be analyzed according to the Brazilian Federal Constitution of 1988 norms and to the social security legislation. Afterward, analyze the nature of the special pension, its jurisprudence, and range of the benefit in the state of Paraíba, in order to identify the special pension’s constitutional aspects, and emphasize that such benefit is unconstitutional and the necessary actions to remove it from legal order.This monographical research uses the deductive and historical evolutionary method, having as research technique, the literature, raising the interpretation and literary review of the main legal doctrines, articles and other sources related to the theme, in addition to the documental technique through recent jurisprudential positions about the theme
