Résumé:
This article intends to expand the debate on homeschooling, known as homeschooling, in Brazil, presenting its context in the world, detailing the reasons and reasons that determine the lack of regulation of this in Brazil, relating them to the social-juridical reality of the country, but mainly the lengthy national path towards standardization, in addition to the possible impacts if this occurs in the country. Emphasizing the contradiction between the transfer of constitutional guarantees of education and freedom, since parents are not allowed to manage their children's education without being compulsorily through compulsory enrollment in an educational institution approved by the State. The main objective of the present work is to inform about home education and its constitution, in addition to clarifying the great judicial clash caused by the divergence between the normative orders, seeking to remove prejudices, speculations on the subject due to the lack of knowledge about this modality. As a methodology, first, the research can be classified as exploratory, as it analyzes homeschooling and its developments in the world, detailing the reasons and reasons that determine the lack of
regulation of this in Brazil, relating them to the social and legal reality of the country. Furthermore, as for the technical procedure, theoretical-bibliographic research was adopted, being developed from the analysis, reading and studies of books and scientific texts by researchers who directly or indirectly studied the subject object of the research.
