Resumo:
With the rapid advance in the growth of society combined with an
industrial/business expansion in Brazil, there was a certain need regarding the
adoption of measures that can contribute to the sustainable development of the
country, making socioeconomic development compatible with environmental
protection. In this bias, environmental licensing arises: it is an administrative
process that enables the legal execution of activities that demand the use of
environmental resources, considered effectively or potentially polluting.
Instituted by the National Environmental Policy, environmental licensing, as an
interdisciplinary matter of Environmental Law and Administrative Law, will be
approached here from a legal perspective in which its normative disposition,
importance, and application are permeated, developed through the
bibliographical review method. Finally, a brief comparative analysis of the
situation of this legal provision during the occurrence of two major
environmental disasters in Brazil occurred in Mariana and Brumadinho, both
cities in Minas Gerais, and its legal impact.
