Abstract:
This monographic work aims to carry out a study about the
importance of the Public Defender's Office for a convict or defendant in criminal proceedings, both
under-sufficient. Likewise, it will aim to demonstrate that
Public Defender's Office is an essential and permanent institution, absolutely
indispensable to the jurisdictional function of the State, which is responsible for the
law, the promotion of human rights and the defense, at all levels, judicial
and extrajudicial, of individual and collective rights, in an integral and free way,
to the needy, as required by the Federal Constitution. In addition, it will promote
a reflection on the non-compliance with the Penal Execution Law and on the
Brazilian Prison System, which is in alarming conditions,
absolutely far from the objective, which is resocialization. Soon after, the
problematic will be about the conditions in which the Public Defender's Office acts in the
city of Catolé do Rocha-PB, more specifically in front of the inmates of the
Standard Prison Manoel Gomes da Silva, an institution located in
lag, being prevented from fulfilling its real objective, which is to grant
free legal assistance to those who are not financially able
to assume the expenses of a private attorney. will be consigned
also the lack of public investment towards the Public Defender's Office, generating
serious consequences for the recipients of its service, such as the
restriction of defense and lack of access to constitutional material equality.
