Resumo:
The present research sought to analyze the scenario of the penitentiary system,
especially the prison management models categorized by DEPEN, comparing them.
For this, a theoretical survey was carried out on public policies and public security,
maximization of benefits, discussions on the outsourcing of public service, and the
public budget of FUNPEN that drive the research. This is because the issue of public
security, despite its importance in governmental agendas, is still a neglected object of
study within Political Science. Nevertheless, as suggested by the theoretical
framework, the prison reality presents itself as worrisome, especially as it is a system
with excessive imprisonment, with management problems, implying low rates of
resocialization. Thus, the Brazilian prison management models presented by the
National Penitentiary Department - DEPEN were analyzed, due to the type of
relationship established in an administrative contract with the public power, namely:
Public, Public-Private Partnership, Co-Management and Non-Profit Organizations; as
well as indicators of services provided in prisons from the set of basic and mandatory
prisons, according the Penal Execution Law and guidelines of the National Penitentiary
Policy. Secondary data were extracted from INFOPEN, DEPEN, Transparency Portal,
Conselho Nacional de Justiça of Brazil, analyzed in a descriptive and comparative way.
Furthermore, the present work presents the case of Minas Gerais, considering that it
is the only Brazilian state that has all management models, serving as a case for
analysis. From the data collected and compared, it can be seen that the management
model does not essentially influence the modification of social indicators in prisons.
However, DEPEN is paying attention to encouraging the adoption of these models,
including directing financial resources in this direction. Finally, it is emphasized that the
problem of the penitentiary system is the lack of information and control in all models,
evidenced by the lack of monitoring of sentences served, inciting excessive
imprisonment and, consequently, super incarceration.
