Resumo:
This monograph aims to analyze the Non-Prosecution Agreements concluded by the
State Public Ministry of Patos during the pandemic period of COVID-19. This
institute, introduced by Law nº 13.964/2019, known as the Anti-Crime Package, aims
to expand the performance of the so-called Consensual Criminal Law, through which,
when certain requirements are met by the investigated, criminal prosecution against
criminals is prevented. this and after the agreement has been fully complied with, the
competent court will order the extinction of punishment and the non-registration of the
criminal record certificate of the author of the crime. In this context and taking into
account the pandemic moment of Covid-19 experienced by humanity, as well as the
essential nature of judicial activity and ensuring the minimum conditions for its
continuity, protocols were developed by the Judiciary in respect of health standards,
instituting videoconferencing as a emergency platform for holding hearings during the
period of social isolation. To this end, the study analyzed the data regarding the nonprosecution
agreements concluded by the State Public Ministry of the city of Patos-
PB during the pandemic period. The methodology used was based on exploratory
research, developed in a qualitative way through bibliographic and documental
research, studies of legislation, judicial decisions, doctrinal positions, case study,
among others, enabling a broadening of the horizon on the subject. It is concluded
that the institute shows promise in the sense of avoiding the establishment of criminal
proceedings, promoting speed and efficiency in the resolution of low and medium
serious crimes and acting as an alternative to the route of formal prosecution by the
Ministerial Body, unburdening the prosecution system. penal system and, above all,
the prison system.
