Abstract:
This paper sought to analyze the Vaquejada with two opposing viewpoints, as a cultural
manifestation, so well recognized in the Northeast region, and as a cruel practice that
mistreats the animals involved in the show. The process of legalization and regulation
of this famous practice was also analyzed, since the clash in the STF between those
who were against and those who were in favor of the legalization of Vaquejada was
quite arduous. It is known that this issue is quite delicate because it is not only about
allowing or not allowing this sport, but we are also talking about something that affects
the economy of an entire region, the lives of thousands of people who live only by this
vaquejada, without belittling, or leaving aside, the right of animals to have a dignified
treatment, as we will address a little later. The general objective of this paper is to
analyze the vaquejada from two points of view, as a cultural manifestation and/or a
cruel practice. The specific objectives are to analyze the concept of cultural rights over
the years and how these concepts have influenced Brazilian legislation, to make an
overview of animal rights and, finally, how all this influenced the law that regulates the
vaquejada. As for the technical procedure, we adopted the bibliographic-documentary,
with direct and indirect treatment of the sources, since it was developed from laws,
books, internet and periodic articles, with content analysis. In this way, we can reach
a conclusion about the subject addressed, and finally, clarify the constant doubts that
surround the vaquejada.
