Resumen:
The act of bidding can be conceptualized as the legal procedure that is used by the public
administration for the contracting of goods and services. From this perspective, it is known
that the government procurement market is responsible for a considerable portion of the
country's Gross Domestic Product. With this, the present study aims to analyze and evaluate
the novelties and changes brought about by the new bidding law regarding the old
legislation. The methodology used in this study is based on bibliographical research, in
addition to the use of comparative analysis to verify the main differences between the laws.
Given this, some relevant changes were identified that the new standard brings concerning
the old one, among them, new bidding modalities and the exclusion of modalities considered
outdated, in addition to changes in the judging criteria that were later known as types of bidding. In addition, a novelty in the bidding phases, with the inversion of the qualification
and judgment phases. Another innovation that the new legislation presents for the bidding
process is the integration of technologies and integrated processes for engineering services,
among these technologies the BIM tool. From the analysis of the results, it can be seen that
the innovations brought by the new bidding law came to make the bidding stages faster and
more efficient, as well as to guide the bidding process concisely and consistently with welldefined
modalities and criteria. The integration of new technologies such as BIM, makes
engineering services more assertive, economical, and practical. Therefore, this study aims
to add knowledge practically for public servants, bidders, and other people who are
interested in the bidding process to participate in it or execute it efficiently.
