Résumé:
It will analyze mediation as an extrajudicial means of resolving conflicts related to the
right to health, an institute present in the Code of Civil Procedure, besides being
regulated by its own law. The general objective of the study is to analyze the viability
of mediation as a method of conflict resolution, seeking to find an answer about the
possibility of resolving conflicts related to the right to health through mediation, with a
conceptual approach about the institute, and to highlight how mediation relates to the
right to health. The methodology applied in this paper uses the deductive method. It is
also important to highlight the bibliographical approach, which will have as a source of
research the framework of the illustrious doctrine, the Brazilian legislation and scientific
papers. This study will present as results the main specificities of the right to health, as
well as mediation as a conflict solver, so that, in this way, the theme becomes more
accessible and dynamic. Thus, from the considerations made throughout this study,
through the information obtained both in the Law and in the doctrine, it verified the
possibility of applying mediation to solve health conflicts related to the right to health.
