Resumo:
This research deals with the factors that hinder adoption and its implementation in
Brazil. Adoption is a time-consuming procedure, in which it is common for the
stipulated completion deadline to be exceeded. The number of available adoption
candidates is much greater than the number of available children and adolescents,
even so, children and adolescents still remain in reception centers for a long period
of their lives. Therefore, the problem of this work will focus on the difficulties of
implementing the adoption process in Brazil, seeking to understand how
bureaucracy and selective preferences contribute to children and adolescents
remaining in foster care institutions. Therefore, the general objective of the
monograph is to analyze the factors that influence slowness in adoption processes.
Regarding the specific objectives, the adoption will be conceptualized, and guidance
will be given on a historical survey of the institute, addressing its main points, and
portraying the requirements for its implementation. It also discusses the
bureaucratic stages of adoption and provides statistical data on the main
characteristics required by applicants eligible to adopt and on the profiles of children
and adolescents available for adoption. For this, the monograph uses the
methodology of the deductive method and statistical and historical technical
procedure. Regarding the general objectives, the explanatory form, and in relation
to technical procedures the bibliographical, through websites, articles, law and
doctrine. With the research, it became possible to confirm the hypotheses, pointing
out a need to search for procedural reasonableness, seeking a balance between
rules and procedural speed, aiming to protect the fundamental rights of children and
adolescents, avoiding unnecessary delays in processes. In addition, it demonstrates
that selective preferences regarding a given profile become a major obstacle in
completing the process, which demonstrates the importance of effective awareness
movements on the subject.
