Resumo:
The management of water resources is essential to ensure a balanced environment for
everyone, which is a fundamental right and duty, essential to the dignity of the human person.
Considering that Solonópole-CE is a small city in the interior of the state of Ceará, in a region
with a semi-arid climate, with low water availability, the present investigation is relevant to
determine whether, in that municipality, water resources are being legally protected
satisfactory. The research’s problem consists of knowing whether the human right to access
water in Solonópole-CE, through the management of environmental sanitation, is in
compliance with the constitutional principles of Public Administration and those relating to the
National Basic Sanitation Policy, established by Law nº 11.445/2007 and the National Water
Resources Policy, in Law nº. 9.433/1997. For the research, the deductive method was used,
the historical procedure method and the comparative method were used to formulate a case
study. This research is applied, exploratory, bibliographic, documentary and qualitative. The
general objective of the research aims to investigate the guarantee of access to water as a
human right in accordance with federal legislation, mainly Law nº 11.445/2007 and its
amendments, in Solonópole-CE. The specific objectives are to understand the historical,
economic and social formation of access to water as a human right in Brazil; understand the
legislation regarding water access and management; verify the application of legal precepts to
the factual reality of Solonópole-CE and prepare a summary table describing the conditions of
access to water in Solonópole-CE. As result, it is clear that, despite the water supply being
considered adequate, Solonópole-CE does not comply with all legal guidelines regarding other
basic sanitation services, especially with regard to sewage and popular participation and
governance, the dignity of the human person is not guaranteed nor the sustainable
development of the municipality is promoted.
