Resumo:
The issue of Criminal Repression will be analyzed in the light of Criminal dogmatics
and the function of the Penalty, a topic of profound relevance in the context of
Criminal Law and Sociology. The general objective of the study will be to investigate
and analyze the origins of this phenomenon, its implications for Brazilian Criminal
Law and possible solutions to mitigate its influence on the criminal justice system.
The methodology applied in carrying out this work will use the deductive method.
The bibliographical approach should also be highlighted, which will have as a
research source the framework of the illustrious doctrine, Brazilian legislation and
scientific works. This study will present the results of the analysis of the selectivity of
the penal system as a complex and multifaceted phenomenon, reflected in the way
in which economic crimes, such as white collar crimes, are treated in comparison
with violent crimes, in addition to impacting prison overcrowding. Thus, based on the
considerations made throughout this study, through the information obtained from
both the Law and the doctrine, the need for more inclusive and humane approaches
to the treatment of individuals in conflict with the law was verified.
