Resumen:
The main objective of this course conclusion work is to analyze whether home
education in Brazil complies with the Brazilian legal system with regard to the
constitutional right to education, given the lack of regulation on the subject in the
country. And its specific objectives are to make a historical analysis of the right to home
education; analyze home education in light of the 1988 Federal Constitution and infra constitutional laws, as well as the understanding of the Federal Supreme Court in
Extraordinary Appeal 888.815, which brought a judgment on the matter. To achieve
the aforementioned objectives, the deductive method and the bibliographic and
documentary research technique were used, and with regard to the general objective
as a descriptive research, with a qualitative approach and the means of procedure
used were historical and analytical-descriptive. Education aims to broadly train the
individual for professional practice and life in society. The right to homeschooling in
Brazil can be understood as a parental right, given their freedom regarding their
children's education. On the other hand, there are criticisms of home education, such
as, for example, regarding the socialization of children and adolescents outside the
school environment. The need to discuss this topic is present given the large number
of practicing families and the absence of a federal standard that establishes detailed
rules on the subject.
