Resumen:
The history of prisons shows that, for many years, especially in the classical
penitentiary systems, the work and educational activities performed by inmates were considered an extension of the prison sentence. However, with the advancement of the punitive system and Criminal Law, the conviction in deprivation of liberty began to have a dual purpose: retributive and preventive. Thus, punishment in contemporary societies has been used to achieve objectives such as the reintegration, re-education and recovery of the convicted. However, it is crucial that the development of resocializing actions occurs efficiently for this goal to be achieved. Based on this bias, the relevance of the social rights guaranteed by the Penal Execution Law to ensure the effectiveness of basic and essential guarantees related to work and educational activities aimed at those who are in prisons is indisputable. Therefore, the objective of this study was to investigate the criteria used to select inmates who develop productive activities, understanding the nature of work in the prison environment, and to evaluate how its execution contributes to achieving the objectives proposed by the legal norms. The research methodology adopted consisted of bibliographic and documentary research techniques, the deductive approach method and qualitative data analysis.
The data obtained showed that despite the existence of important legal provisions on work and educational activities, several aspects lead to institutional violence, resulting, for example, from the poor working conditions for the prison population, overcrowding, lack of financial resources, inadequate infrastructure and the neglect of the government to expand policies aimed at resocialization through work and study. Therefore, the conditions presented neglect what should actually be offered, such as clean and adequate environments, access to work and effective resocialization. Therefore, the State needs to repair the Prison System, in the establishment of relevant
resources and implementation of Public Policies, in order to improve the terrible conditions in prisons and, mainly, in the process of resocialization.
