Abstract:
The present work aims to analyze the possibility of fitting electronic sports within the current legislation on sports in the national legal context, conducting a brief study on e-sports and their development on both national and international levels. The research problem is defined as follows: Is there a regulatory framework in Brazil that governs electronic sports? To address
this, an analysis of existing regulations was conducted, and an exploration was made to understand whether there was a need for a specific law to regulate this activity, as well as to protect the rights and duties of those involved in the sector, developing an understanding of its derivative aspects. Thus, the study adopts a qualitative and bibliographic approach. To collect data, periodicals, legislations, jurisprudence, doctrines, and works addressing the topic of
electronic sports, their consequences, impacts on the market, and the industry were selected. It is important to note that there was no specific time frame limitation in relation to the period covered in the periodicals, due to the limited number of publications available on this subject. The results suggest the possibility of legal classification through legislative amendments; however, there remains a need for the creation of specific legislation. The research's relevance and contributions lie in expanding the knowledge of the scientific community, society at large, and the practitioners of sports regarding the significance of electronic games as a sport discipline.
