Resumo:
This work is part of the scenario of advances in the artificial intelligence sector, which is gaining ground in everyday life by promoting, among other things, the optimization of tasks and increased productivity. In this scenario, the focus of the theme centers on the use of said technology for creative purposes, more specifically in the creation of artistic works. The study theme presented refers to the legal consequences brought about by the use of AI mechanisms in the scope of Civil and Copyright Law, focusing on the different types of damages that can be observed and problems that involve the liability of agents involved in the operation process of the AI application. The general objective of this research is to evaluate the legal consequences arising from the use of
AI systems in the creative process of artistic works, analyze different understandings on the topic and compare them to arrive at the best scenario. On a second level, based on the analysis of the existing mechanisms in the legal system, both nationally and internationally, we also seek to verify whether the legal framework in the state in which it is found offers legal support to the issues raised. For the investigation, the deductive method was used, based on bibliographic and documentary research techniques. Thus, considering that both national and international mechanisms were analyzed, it is clear that the relevance of the topic permeates the Brazilian context, also reaching the international scenario. It is noted that the issue related to the implementation of
specific standards is urgent, since the speed with which new technologies are created is, in fact, far ahead of the speed of the legislator.
