Abstract:
The phenomenon of domestic and family violence against women is a manifestation
of gender inequality rooted in a deeply sexist society, which not only affects the
physical and psychological integrity of women, but also directly violates their human
rights. This case study aims to analyze the effectiveness of the Maria da Penha Law
and urgent protective measures in the State of Paraíba, which represent the main
legal instruments for protecting women in situations of domestic violence. The
research is based on a broad bibliographical review, consulting Brazilian legal
doctrine, scientific articles and relevant jurisprudence. The methodology used is
comparative and deductive, incorporating a historical analysis to understand the
evolution of the Maria da Penha Law and protective measures over time. It was
observed in this study that, through the comparison of data provided by the Court of
Justice, obtained through the Ombudsman's Office, there was a reduction in cases of
femicide among victims who sought protective measures compared to those who did
not. This highlights the importance of these measures as an effective tool to protect
women in situations of violence. It was also noted that the State of Paraíba offers a
variety of programs and services to support victims and the significant challenges
they face. The study showed that the effectiveness of protective measures largely
depends on adequate supervision and implementation by the authorities. Therefore,
promoting more rigorous supervision, and raising awareness among victims about
the importance of seeking these measures is essential for the effective protection of
women in situations of domestic violence in Paraíba.
