Abstract:
The work has as a research problem to evaluate the results of the public policy of implementation of the Special Criminal Nucleus - NECRIM, in the State of São Paulo, from the year 2010, to conclude if the referred project created with the objective of applying the consensual resolution of conflicts between citizens who seek the State guarantees speed and efficiency in the provision of the public service of assistance to victims of crimes, misdemeanors or who have suffered civil damages, without the need for processing through the Judiciary, triggering criminal or civil proceedings that end up burdening the Public Power and the Justice, making the solution of the problems that the citizen seeks to solve slow and unsatisfactory. The objective of this work is to conclude whether this public policy is capable of enabling the solution of conflicts through mediation and conciliation carried out, preliminarily, by the Police Chief, at the Judiciary Police headquarters, that is, at the Police Station itself, where the the population's first contact with the State, since the Police Station is a gateway for society to resolve its conflicts of interest. Thus, through statistical analysis and data referring to the results of the project implemented in the State of São Paulo, pioneer in the installation of the so-called “NECRIM”, an overview of its functioning after implementation by the São Paulo government was drawn, analyzing whether the referred public policy had ability to optimize the provision of public security services and guarantee the protection of citizens' rights. An analysis was made of the change of scenery regarding the traditional notion of repressive public policies, in which the State only represses crimes and punishes the culprit, to a model of restorative public policies, more concerned with solving the citizen's problem, reconciling the parties, to reduce the recidivism rate to the detriment of the actual punishment of the person who committed the offense, working from the perspective of institutional innovation. For this purpose, the descriptive method was used, with the sedimentation of aspects of project implementation, collected through bibliographical research, as well as the application of quantitative and qualitative methodological procedures, using the data collected through documentary evidence and secondary data, collected through the Secretary of Social Defense of the State of São Paulo, using the Citizen's Information Service, preparing descriptive statistics, tables, graphs and verifying averages, to indicate the results obtained with the implementation of the Special Criminal Nucleus, in the State of São Paulo, based on the historical series between the years 2010 and 2020, in order to conclude its effectiveness as a public policy in the area of public security and consensual conflict resolution.
