Abstract:
The problem of domestic violence against the female gender is in the order day of debates and actions of social scientists, managers and politicians in general. Although the feminist movements organization, the improvement of laws and public policies search unceasingly for ways of eradicate and inhibit this sexist practice that violates the human rights, the cases of women victims of this kind of violence are not rare. Thus, the goal of this study is analyze the operation of the Maria da Penha‟s law at the county of Sousa – PB between 2015 and 2017, specifically in cases of recidivism; and also to identify the main reasons that lead to the recidivism of the victim in the relationship of domestic violence. In this work, it was performed a qualitative nature research. Initially it was performed a bibliographic study trying to bring concepts that could explain the reasons of the practice of aggression against women, as also a short historic of feminist struggle and about the achievement of Maria da Penha‟s law. Following that, it was performed a field research by means of a semi-structured interview that aims to know the local specificities in the recidivism cases in the Maria da Penha‟s law. It was found as study results, that due to the absence of public policies directed towards the women that suffer with domestic violence, and because the cultural values with paternalistic content accepted by common sense as incontestable truths, in the recidivism cases, the Maria da Penha‟s law at the county of Sousa – PB is fragile and insufficient to achieve its goals, whatever they are: prevent and eradicate the domestic violence against women.
